TERMS AND CONDITIONS OF SERVICES

These terms and conditions outline the user agreement for enrollment at American Institute of the Gifted and Talented. We review our terms and privacy policy annually. By enrolling, maintaining enrollment and using our educational services, you implicitly affirm your agreement to the terms and conditions hereby outlined.

1- SERVICES

AIGT is a full service, live online school for grades K-12, registered via affidavit with the California Department of Education. We offer over 100 grade level courses, taught via live, teacher-led classrooms with students of like-ages. General services for our learning community will fall under the category of synchronous and asynchronous teaching/learning, grading and record keeping, and personalized educational support services.

 

2- ACADEMIC PROGRAMS

For grades K-12, you agree to comply with the following:

  1. Understand that AIGT is an educational institution registered via affidavit with the California Department of Education and must enforce the fulfillment of and compliance with the California State Standards and grading criteria for students in grades K-12.

  2. Thoroughly read through the AIGT Community Handbook and contact the General Coordinator should any questions arise within the first 15 days of enrollment.

  3. Commit to providing your student with the proper support, involvement, and home study environment to ensure the best possible setting for effective learning and success.

  4. Ensure availability and proper functionality of electronic resources (personal computer, speakers, microphone, camera, etc.), and internet connection with the following minimum specifications:

    1. 250 GB hard drive or higher

    2. 4 GB RAM or higher

    3. 2.0 GHz Intel or AMD processor

    4. Windows 10 or MAC OS 10.10 or later

    5. Google Chrome, Microsoft Edge, Firefox 48 or later; Safari 11 or later

    6. Anti-virus program (updated regularly)

    7. Computer microphone and speakers

    8. Web Camera

    9. High-speed Wi-Fi connection obtained either at home (preferred for the best study    setting) or via an outside source, such as the library, etc.

  5. Register and activate all learning applications (mobile and/or desktop versions) and online platforms indicated by the institute upon enrollment.

  6. Oversee my student’s progress via the parent or student ‘s portal in AIGT’s Learning Management System (LMS), and the daily agenda.

  7. Check my personally assigned account via Class Dojo at least twice a week for news from AIGT regarding personal and community level correspondences (notices, announcements, tuition payments, etc.)

  8. Ensure that your learner completes and uploads at least 70% of all assignments, projects, and assessments to the LMS as indicated, regardless of participation in the daily, live online class or via independent study offline.

  9. Take the necessary steps to encourage and motivate your student when the feedback from the teacher(s) at AIGT report insufficient evidence of progress or lack of effort during at least two (2) consecutive weeks. These steps should include reaching out to your student’s online teachers, and/or general coordinator to identify and implement a clear plan of action in the best interest of your learner.

  10. Accept any adjustments made on behalf of AIGT regarding the school calendar dates, assignment due dates, assessments, events, fairs, or other scheduled activities.

  11. Affirm that the curriculum is designed for students to work at his/her pace on a weekly basis, therefore all work must be submitted by Sunday of each week unless previous arrangements have been made with the title teacher or coordinator.

  12. Understand and accept that all work must be submitted by the end of each twelve (12) week academic period.

  13. Understand that enrollment does not imply a passing grade for the grade level. A passing grade for any course is considered 70%. Your student will receive a grade for each assignment, and 10 points will be taken off for each day the assignment is turned in late. Additionally, a zero will be recorded for each incomplete assignment.  

  14. Accept that your student will receive a report card with the mark “Incomplete” for courses where less than 70% has been achieved.

  15. Understand that there will be an additional enrollment fee and tuition for extraordinary assessments, extended course periods, or summer school to make up for courses marked “Incomplete”.

  16. Authorize investigation and suspend the use of the learning platform temporarily or indefinitely in case of extreme and persistent “technical” errors in your student’s work submissions due to academic misconduct (such as plagiarism or cheating), submission of blank or erroneous assignments, manipulation of submission windows, etc.

  17. Acknowledge, respond, or communicate with AIGT’s staff and faculty in a timely manner to avoid having the student’s account suspended in extreme circumstances.

  18. Review and comply with your state’s homeschooling requirements. Consult resource here

  19. Understand that occasionally, AIGT may spotlight or showcase their students’ achievements or accomplishments with stakeholders and/or for marketing purposes through internal or external communication. In all cases, AIGT will only publish the student’s first name, first letter of last name, grade and city and state relevant to the occasion, unless additional permission is granted by you to elaborate on your student’s identity.  

3- ATTENDANCE

AIGT will track your student’s academic progress and attendance through the Learning Management System through staff and faculty input. You will be required to manually input attendance for your learner on days that the student works offline via independent study.

As a California Private School (PSA), AIGT is required to company with truancy laws as found in the Education Code 48260. This law defines truancy as a child who, without a valid excuse is:

  • absent for 3 full days in a single school year,

  • tardy 3 times in a year,

  • absent 3 times for more than 30 minutes, or

  • any combination of the above.

  • missing 10 percent of the school year (Code 48263.6)

Therefore, you will be required to report excused absences (illness, dr. appointment, etc.) to the General Coordinator via email at contact@americaninstitutegt.org in a timely manner.

 

A student that has not been active for more than 3 school days or shows little or no evidence of progress without a previous written valid excuse may risk being truant and withdrawn from the enrolled program.

4- TECHNOLOGY AND RESOURCES

The following guidelines for compliance with regard for the responsible use of technology and resources will assist in maintaining the safety and success of your learner:

  1. The learner will access information, resources, services, products, and tools we provide, either directly or indirectly only for the purposes intended and as permitted for your learner's individual account. Attempting to access or accessing any of the resource by any means other than through the means provided at the time of enrollment or thereafter, is strictly prohibited.

  2. You agree that you and your student will use the technology necessary to complete your enrolled program and not put you, your student  or others at risk and always respect the digital privacy of others. This includes complying with software licensing agreements, trademarks, copyright, and fair use laws.

  3. Your student is expected to upload, share, create or post appropriate digital content to fulfill assignments pertaining to his/her learning process (such as in a blog, chat, forums, document upload, etc.) in an ethical and responsible manner. Additionally, s/he must avoid resources that are inappropriate (defamatory, threatening, abusive, etc.), offensive (discriminating, degrading, racist, explicit language, etc.), or illegal (threatening, harassing, fraudulent, etc.). If s/he sees inappropriate material online, you should report it to the assigned teacher or any staff at AIGT, immediately.

  4. AIGT reserves the right to remove any content that does not comply with this user agreement, including content that we feel otherwise offensive or an infringement on the well-being of our school community, school philosophy, mission, and vision, or third-party. We will use our sole discretion in determining and removing inappropriate content for which you waive any claim against us. Furthermore, as the posting of content by you, your student or a third-party user may be beyond our control, we do not assume any responsibility and expressly disclaim any liability for any of the content posted.

  5. Your student agrees to provide necessary information about her/himself (such as identification, passwords, etc.) to access the various resources that are required for participating in our online synchronous and asynchronous courses, and other services. It is agreed that only the information pertaining to the student's assigned personal account will be used and confidentiality of all information associated with his/her ability to access the resource will be maintained. Attempting to copy, duplicate, reproduce, sell, publish, trade, or resell our resources is strictly prohibited and may have consequences and incur criminal or civil liability.

4- WITHDRAWL FROM COURSE OF STUDY

Students will be assigned classes, teachers, and support staff upon completion of the enrollment process. If you choose to withdraw your student from AIGT, you must do so by filling out the Notice of Withdrawal form.

The Notice of Withdrawal form will not be processed if there are tuition or other outstanding fees.

Once the Notice of Withdrawal is finalized, refunds will be processed based on our refund policy.

In the case you decide to reenroll your student after the Notice of Withdrawal has been finalized, you will be required to pay the enrollment fee for returning students, regardless of the time that has passed since last enrollment.

Grade reports, transcripts and other documents will not be released until the Notice of Withdrawal has been finalized, and tuition and fees for the student has been fully paid.

AIGT reserves the right to withdraw a student from the school for violation of our Code of Conduct.

  

5- REFUND POLICY

Cancellation of courses and refunds will be considered as follows:

  1. Enrollment fees: A refund will be honored up to 72 hours after payment, less processing fees.

  2. Yearly paid tuition: A refund will be honored up to 7 days after payment, less processing fees.

  3. Payment installments: A refund will be honored for the payment of the first installment up to 7 days after payment, less processing fees.

  4. Monthly tuition: A refund will be honored up to 72 hours after payment, less processing fees. Subsequent months are not eligible for refund.

  5. Digital material and licenses: Refunds will be honored up to 7 days after payment.

  6. Books and material:  Refunds will be honored for unmarked books in new condition returned to our offices within 12 days of the invoice date. Shipping charges are non-refundable.

 

All refunds will take 3-10 business days to process.

6- LIMINTATION OF WARRANTIES

By using our website and educational programs and services, you understand and agree that all resources we provide are “as is” and “as available”. This means that we do not represent or warrant to you that:

  • i) the use of our resources will meet your needs or requirements.

  • ii) the use of our resources will be uninterrupted, timely, secure or free from errors.

  • iii) the information obtained by using our resources will be accurate or reliable, and

  • iv) any defects in the operation or functionality of any resources we provide will be repaired or corrected.

Furthermore, you understand and agree that:

  • v) any content downloaded or otherwise obtained through the use of our resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content.

  • vi) no information or advice, whether expressed, implied, oral or written, obtained by you from AIGT through any resources we provide shall create any warranty, guarantee, or conditions of any kind, except for those expressly outlined in this agreement.

7- LIMITATION OF LIABILITIES

You affirm that you shall defend, indemnify, and hold harmless American Institute of the Gifted and Talented and its affiliates, from and against any and all claims, lawsuits, demands, causes of action, liability, loss, damage and/or injury, of any kind whatsoever, whether brought by an individual or other entity, or imposed by a court of law or by administrative action of any federal, state, or local governmental body or agency, arising out of, in any way whatsoever, any acts, omissions, negligence, or willful misconduct on the part of its officers, owners, personnel, employees and agents, contractors, invitees, or volunteers. This indemnification applies to and includes, without limitation, the payment of all penalties, fines, judgements, awards, decrees, attorneys’ fees, and related costs or expenses, and any reimbursements to AIGT for all legal fees, expenses, and costs incurred by it.
